Abstract:

Odisha, an eastern Indian state, boasts abundant natural resources and a rich diversity of flora and fauna. This natural wealth, however, presents the challenge of balancing economic growth with environmental conservation. The judiciary in Odisha has played a pivotal role in this balance, delivering significant rulings that protect the environment while also considering developmental needs. This study explores the judicial approach in Odisha, India, to environmental challenges linked to development initiatives. Through a detailed case study, the dissertation investigates the judiciary's efforts to reconcile economic development with environmental conservation. It provides valuable insights into the judiciary's evolving role in protecting Odisha's environment while recognizing developmental ambitions. The analysis emphasizes the use of Environmental Impact Assessments (EIAs), the precautionary principle, and public participation by courts to promote sustainable development practices. It also discusses the implementation challenges and the importance of cooperation among the judiciary, government, and citizens.
