Tracing synergy between environmental law and energy law in India: assessing climate-energy challenges in 21st century

Abstract:

In order to reduce energy and environmental law and to keep energy security, a number of developing nations are utilizing their inventiveness to encourage renewable energy sources in the power business. India is taking steps to ensure supply security and reduce its carbon footprint. Reforms in law and policy are required to accomplish the aforementioned goals. Thus, this proposal looks at how laws pertaining to renewable energy are created in various Indian jurisdictions with diverse political landscapes. There is a clear deficiency in legal education in India with regard to the laws governing the production of renewable energy. Thus, the regulatory framework for renewable energy in legal systems primarily affected by civil law jurisprudence is examined in this literature.

The majority of nations that rely on the production of green electricity appear to have two main concerns: a strong desire to stop the severe environmental effects of climate change and worries about maintaining national security through control over energy resources. The European governments put a lot of effort on creating uniform legislative mechanisms for renewable energy, among other things. Conversely, India has implemented significant laws, created regulations, and started solar energy initiatives to draw in investors who see renewable energy sources as a way to achieve electrical independence. In the meanwhile, it invested in green energy through self-commissioned licenses and unaltered power policies. However, the primary source of both benefits and drawbacks remains the laws and rules governing the usage of non-brown electricity. In order to meet its future ambitions for renewable energy, India will need to reorganize its regulatory framework and harmonize its policies.

The researcher proposes to study the development of environmental law and energy law in India. Furthermore, study the synergy/interface between the environmental law and energy law while assessing the climate-energy challenges faced in 21st century from an Indian perspective.
