Abstract:

The comprehensive examination of plant variety protection (PVP) laws in India and their global context. The study focuses on the significance of PVP in promoting agricultural innovation, food security, and the sustainable use of plant genetic resources. It highlights the role of the International Union for the Protection of New Varieties of Plants (UPOV) in shaping global standards for PVP and the diverse approaches adopted by developing countries, including India's Protection of Plant Varieties and Farmers' Rights (PPV&FR) Act.

It involves exploration the challenges and opportunities presented by PVP systems, including the need to balance breeders' rights with farmers' interests. It discusses the importance of the Distinctness, Uniformity, and Stability (DUS) test in evaluating new plant varieties and the limitations of the conventional phenotypes-based DUS test. The study also examines the Trade-Related Aspects of Intellectual Property Rights (TRIPS) Agreement and its implications for PVP regulations. It concludes by emphasizing the need for tailored PVP systems that address the unique agricultural practices and socio-economic contexts of developing countries. It underscores the importance of striking a balance between breeders' rights and farmers' interests to ensure that PVP systems effectively support agricultural development, innovation, and food security in a manner that is inclusive and sustainable for all stakeholders involved.
