Telecommunication at the standpoint of competition and confluence between the two laws

Abstract: India comes second after china when it comes to its market for telecom users in the world. The user base has increased as we come into era of globalization and opened the economy. There is an increase in economic and social growth directly proportional to increase in penetration in the market.i There is parallel progress ratio between Gross domestic production of rural areas within many countries and provision of mobile and telecommunication services, as per UNCTAD. The current share of telecommunication is 3% in India‟s GDP. There are a lot of services that are covered in telecom services that is wireline, wireless, internet and broadcasting. All of them have their own challenges and some are anti-competitive in nature. With these anti- competitive challenges come the problem of jurisdiction i.e. where will the with competition commission of India who has to look after competition issues or with telecommunication authority of India who has jurisdiction over all telecom issues. So far the regulators have fail to come up with solution unlike other countries who have tried to determine the appropriate jurisdiction and this research analyze these problems and their solution.
