Abstract: India hopes to go nuclear by the year 2022. This mammoth plan has been necessitated by the inadequate power supply that is characterized by power outages, drips, blackouts and rationing. This is the worst recipe for a country whose economic ambitions have so far hit rooftops. The present power supply situation will plunge the country into unprecedented economic development quest dead-end.

Therefore, the plan to go nuclear is welcome news, as it is hoped to turn tables as far as electricity energy supply is concerned. However, the nuclear program cannot be blindly pursued without evaluating India‘s precarious position, the myriad issues threaded to nuclear energy implementation and use and the ever glaring safety issues that have put to test even the most powerful nations on mother earth.

The country lacks the requisite technology, financial stamina and the necessary regulatory mechanisms to implement this program with fewer hassles. These are considerations that gloss the center stage of the whole process.

It is on the basis of these overarching challenges that the country should tread with caution and due diligence. The hunger for power should not blur its vision for ensuring that the country does not plunge into unfathomable problems.

This dissertation endeavors to explore the viability of this gargantuan quest, the legal framework and the best route for India to march through.
